The case of a 12-year-old girl in Wales, who was rushed to a hospital with a stomachache, to give birth to her brother’s baby, who had raped her, causes horror.
The girl was just 11 years old when her 14-year-old brother raped her in the family home, as revealed in the Swansea court.
The two siblings grew up, according to the 14-year-old’s lawyer, in a “dysfunctional” environment with “blurred sexual boundaries” and parents exercising little control over their children and creating a culture of “secrecy and lies”.
The perpetrator, who is now 16 years old, had previously pleaded guilty to two counts of seducing a minor. The case came to light when the girl was taken to a hospital in Karmartensir at dawn with severe stomach pain and two hours later gave birth to a baby.
A midwife carefully asked the little one if she had had sex and she replied that she did not know. When asked if he had consented, the 12-year-old said she was not sure.
The prosecutor told the court that it was not clear whether the girl had realized she was pregnant, as contrary to what she said to the midwife, some heard her tell other people in the hospital that she knew.
Her brother testified during the interrogation that he was fighting for fun with the little one while their parents were away and then they went up to the bedroom upstairs, where they continued playing, started kissing, took off their clothes and had sex.
The prosecutor admitted that there were no clear indications that the perpetrator used threats or coerced his sister.
The girl, in a statement read in court, stated that she does not want to return home and that all she wants is to live normally, like all girls her age and wishes the baby to live a comfortable life.
The 16-year-old’s lawyer said that his client from the age of 10 was exposed to pornographic material in the family environment.
The young man now lives with adoptive parents, responds to their positive influence and has regrets for what happened, he added.
He called on the court to follow the recommendations of experts not to impose a prison sentence on his client.
The court finally placed the juvenile offender under two-year surveillance by the authorities while he will remain on the register of perpetrators of sexual crimes for thirty months.
