Court directs police to vacate LSK premises with immediate effect

The High Court on Monday afternoon barred police from entering into the LSK offices pending hearing of a case filed by President Nelson Havi.

Justice Antony Mrima also barred the police from entering and interfering with the affairs and operation of the society.

In his ruling, Judge Mrima has given Havi, vice president Caroline Kamende and council members unrestricted access of the office.

The court also noted the issue of representation at the LSK where two lawyers have each come on board saying they had instructions from the society.

“It comes to the fore that there is need for some interim orders with a view to curtail any uncalled for interference of the operations and affairs of LSK at its premises on parcel land by the police,” it said.

On the issue of the stalemate on representation between the two factions at LSK, the court noted that LSK must settle the issue promptly since it affects the case.

Havi’s and society CEO Mercy Wambua’s fight over control of LSK has seen both instructing different lawyers to come and represent them, each arguing that they have instructions from LSK.

The court noted that any representation of the society outside a resolution of a property convened council meeting or general meeting cannot stand unless extreme and compelling circumstances dictate otherwise.

“The prevailing situation of the society calls for a more practical way on the aspect of representation,” the court noted.
