Two Charged For possession of ethanol

Two businessmen have been charged with being in possession of unaccustomed goods contrary to section 200(d) (iii) of the East Africa Community Customs Management Act, 2004.

Martin Ng’ang’a and Julius Njoroge Mburu, who appeared before magistrate Francis Andayi at the Milimani law courts, denied the charges pressed against them by the prosecution.

The court was informed that the two committed the offense on September 7, 2021 at Viken Thirty Industrial Park in Ruai area along the Eastern by pass, Nairobi County.

The two suspects, with others not before the court, were reportedly found in possession of unaccustomed goods which 153,580.50 liters of ethanol contained in drums with a dutiable value of Ksh53m in contravention of the East Africa Community Customs Management Act, 2004.

The presiding magistrate granted the two suspects a bond Ksh1m or a cash bail of Ksh500,000. He heeded to the plea by the defendant lawyer of the first accused Mr Gwandaro, who argued that the accused has three kids and has a known resident, and thus was not a flight risk.

“I have considered the mitigation for bail by the learned counsel and I hereby grant the two accused persons a bond of Ksh1m or a cash bail of Ksh500,000” Chief magistrate Francis Andayi ruled.
