JSC Nominates Martha Koome For Chief Justice Post

The Judicial Service Commission (JSC) has nominated Court of Appeal Judge Martha Koome for the position of jurist to replace David Maraga.

JSC failed to disclose marks scored by Koome or the nine other candidates who were interviewed for the post.

Other candidates who were interviewed for the position are Chitembwe Said Juma, Justice M’inoti Kathurima, Justice Nduma Nderi, Lumumba Nyaberi, Justice William Ouko, Justice Joseph Sergon, Alice Yano, Philip Murgor.

On Tuesday, renowned law professor Makau Mutua and Katiba Institute filed an application within the court seeking an order to compel the Judicial Service Commission to publish marks scored by each candidate interviewed for the position.

In the petition filed on Tuesday, the 2 said there was need for the results to be released to the general public for transparency.

Mutua said he had also applied for the position of magistrate in 2016 but wasn’t successful but the commission has never released his results to him.

He said he wrote to JSC seeking information referring to the standards for evaluation of qualification, particularly if the factors used included indicators aside from those provided under Section 13 of the JSC Act.

However, the commission responded saying they’ll not disclose the said information to him so as to guard the privacy of all the applicants.

Mutua wants the court to prevent the commission from forwarding the name of a nominee to the President until the case is heard and determined.

The case was filed hours after the Appelate court suspended an jsder by the judicature wgich had barred the JSC from naming the candidate selected from the ten interwed for the CJ post.
