High Court cancels appointment of 128 parastatal appointments

President Uhuru Kenyatta’s appointments of 128 State Corporations heads and board members have been invalidated by a three-judge High Court decision.

The court stated in its judgement that appointments should be done in a transparent way, including the announcement of vacancies and interviews, to ensure that all Kenyans have a fair shot.

Retired Chief of Defense Forces Gen. Julius Karangi, former Kenya National Union of Teachers head Mudzo Nzili, former Mombasa gubernatorial candidate Suleiman Shabhal, and former governors Benjamin Cheboi (Baringo) and Doyo Godana (Isiolo) are among the appointments who have been affected.

The Head of State and Cabinet Secretaries made the appointments in 2018.

The verdict came after Katiba Institute and the Africa Centre for Open Governance (AfriCOG) sued the government over the nominations, claiming that the legislation had not been followed.

The Court also struck down a number of post-2010 statutes that allow parastatal appointments without regard for fair competition or merit.
