Senator Isaac Mwaura’s seat has been declared vacant by Senate Speaker Kenneth Lusaka following his successful expulsion from his parent party, Jubilee.

The ruling party’s decision to remove the Nominated lawmaker from the party list on the grounds of indiscipline was upheld by the Political Parties Disputes Tribunal.

The tribunal determined that the party followed due process in expelling the Senator and that all laws governing disciplinary proceedings were followed.

“It is notified for the information of the general public that pursuant to Article 103 (1) (e) (i) of the Constitution and section 37 of the Elections Act, the seat of the Member of the Senate elected under Article 98 (1) (d) of the Constitution and held by Hon. Isaac Mwaura Maigua became vacant, with effect from the 7th May, 2021,” said Speaker Lusaka in a gazette notice.

In February, Mwaura was one of six Senators expelled by the ruling party for alleged gross misconduct.

For violating the party’s constitution, Seneta Mary Yiane, Wago Naomi Jilo, Millicent Omanga, Prengei Victor, and lman Falhada Dekow were also kicked out.

Legislators who refuse to toe the party line will face disciplinary action, according to the Jubilee Party.

The ruling party’s decision to expel Mwaura was temporarily halted by the High Court last month pending the outcome of his case.
