JSC allows petitions seeking Justice Chitembwe's removal from office

The Judicial Service Commission (JSC) has given a green light to petitions launched against High Court Judge Said Juma Chitembwe seeking his removal from office.

In the petitions brought before the JSC, Justice Chitembwe’s accusers want him relieved of his duties over alleged abuse of power.

Amid the accusations, the commission met on Monday and deliberated on the petitions and other allegations of impropriety and misconduct that have been brought to its attention.

And after the meeting, Chief Justice Martha Koome-led commission believes the judge must clear the air. JSC says Chitembwe has an opportunity to tell his side of the story.

“Upon deliberations, the JSC resolved that the petitions be served upon the Honorable judge for his response within 14 days of service,” Koome said in a statement

Koome, however, disclosed that Chitembwe’s feedback will be reviewed alongside all the allegations leveled against him by a special committee established to probe his conduct.

This, it appears, will determine the fate of the underfire judge in the corridors of justice.

“Thereafter, the petition’s and the Honourable Judge’s response will be considered by a panel which has been set up by the commission. The panel will present its findings and recommendations to the commission.” Koome indicated

Amongst the Judge’s accusers is Former Nairobi Governor Mike Sonko who has released a series of recordings allegedly implicating Justice Chitembwe of corruption.

The CJ insists that JSC is committed to values of integrity and accountability in the Judiciary.
