Moseti and Toba: Ameru Are Undecided on Who’s Telling the Truth

Jeff Moseti was hired as a bar manager at the Classic bar located next to the Kensilver Express office in Maua-Igembe.

Mr. Moseti in an interview with BaiteTv addressed claims of harassment by his former employer, Toba Meme, who also sells Miraa.

Mr. Moseti told BaiteTv that he had worked for 26 days without being paid when he suddenly became ill and was unable to report to work for two days.

While he was recuparating, the bar owner accused him of stealing Ksh 46,000.

“I was hired as a bar manager, and we agreed on a daily wage of Ksh 1000. My working hours were day and night because the bar used to be open 24 hours a day, which violated the covid-19 guidelines.

“After 28 days, the allegations were proven false because we made sales of less than Ksh 3000 in a single day. As a manager, I was not in charge of the money. My roles and responsibilities included stock-taking, employee management, and ensuring the smooth operation of the business.

“On April 23, I was arrested after being reported to the Maua police station, where I spent the night in a cell. I requested that the Maua OCS release me on free bond due to stomach complications. I promised to return for the case hearing later.

“When Toba was informed that I was being released, he asked that I stay inside. He claimed to be ‘in charge.’ I was scheduled to attend on April 30, so I showed up and waited for Toba from 8:00 a.m. until 5:00 p.m. when he arrived.

“He insisted that I be held in custody until I was charged with stealing his money in court. Mr. Toba’s bar does not have an age limit for entry. On Sundays, he usually invites students to dance for him until 9:00 p.m., when he begins to give them alcohol.

“When questioned, he claims he has nowhere to be taken. As I speak, I have the feeling that my life is in danger because his accomplices with whom he sells Miraa have been following me.

“I noticed it when I saw them near my house’s gate before going inside. They also followed me with a car a day prior to my arrest.

“Mr. Tobia asked me to recruit workers for him, and after one of them worked for two weeks and the other for three weeks, he fired them without paying them. The workers now claim that I owe them money, and to make matters worse, Toba lied to the police during my arrest, claiming that he had given me the money to pay them.”

Mr Toba Meme said: “I’d like to clear the air on the allegations that I harassed and refused to pay the barmanager. I owe no one anything. However, the manager stole my money, and I have filed a police report against him. I will see to it that the case is brought to court so that he can repay the money he stole.

“He is playing the victim in order to avoid repaying my money and is being used by my critics to tarnish the company’s name. The former bar manager has a habit of tarnishing people’s businesses and has been doing so for quite some time.

“The allegations that I did not pay the former employees are untrue. They waited three weeks before accusing me of refusing to pay their money when they should have asked me the day they were fired.”

Dj Tiger said: “Mr. Toba hired me as a DJ during the classic bar’s launch. Even though I offered my services for 24 hours, which was not the original terms, I received no payment.

“When I asked Mr. Toba for payment, he told me to ask the bar manager because he was the one who hired me. When I questioned him about how he did his work, the bar owner told me that there was nowhere I could take him.

“True, there was nowhere I could take him because I received no help when I reported him to the Maua police station. It’s been two weeks with no success, and when he’s summoned to the police station to answer the allegations, he’s the only one who gets to speak.”

Winfred Gakii said: “I used to work for Toba after failing to find work elsewhere. I agreed to work as a waitress at his bar because I needed money and had no other options.

“When I applied for a job at the bar, Mr. Toba directed me to the bar manager, who asked for my resume. On April 2, I started working at Classic Bar for the first time.

“Mr. Toba used to claim that his bar was open 24 hours a day, seven days a week, and he was furious when this did not occur. When the curfew began, the customers were locked from the inside, and anyone entering had to say his name. If the customer is known, he will be allowed in.

“I was used to working the day shift and having to wait until late at night for someone else to take over the night shift. It became impossible to leave late at night, so I was forced to spend the night on a couch at the bar.

“I couldn’t leave for lunch or supper because I was working during the day, and I couldn’t leave in the evening because the nightshift employee needed to arrive.

“The watchmen used to complain about not being paid. On April 4, after working for two days, I became ill as a result of a cold I caught while sleeping on the couch.

“I asked Toba to help me with the money for the hospital but he told me to come back the next day. On April 5, the wife arrived to take stock, and when I inquired about the money, I was told to inquire about it on the next day, April 6.

“On April 6, the wife arrived, and we took stock. She left with all of the money from the previous night’s sales. When she returned, I asked her for Ksh 2000 for the hospital.

“She began speaking in a hushed tone and stated that an employee is eligible for payment after two weeks of service. I have yet to be paid.”
