Out of the 41 judges suggested by the Judicial Service Commission (JSC) last year, President Kenyatta appointed 34, leaving six vacant.
In a list published in a special issue of the Kenya Gazette yesterday, judges George Odunga, Weldon Korir, Aggrey Muchelule, Evans Kiago, Judith Omange, and Joel Ngugi were left off.
On May 13, 2021, five justices declared the Building Bridges Initiative (BBI), a product of the Handshake between President Uhuru Kenyatta and opposition leader Raila Odinga, “unconstitutional, null and void.”
Tharaka Nithi Senator Kithure Kindiki has urged the Judicial Service Commission to request that President Uhuru Kenyatta set up a tribunal to probe the six judges who were denied promotion.
The senator claimed in a Facebook post that the judges’ character has been stained and that they cannot completely fulfill their duties with confidence.
“There is no way the six judges who were humiliated by the President yesterday will enjoy the full confidence of litigants going forward. Their character has been improperly soiled and their dignity questioned,” he said.
“The Judicial Service Commission ought to recommend tribunals be set up by the President to either have them removed from office or to clear them and have them reinstated, promoted, and compensated for loss of reputation. This matter is not as simple as it appears,” he added.
