In a sworn affidavit, Dr. Gikenyi, a general surgeon at the Nakuru Level Five Hospital, declared the President of the Republic of Kenya’s action of purporting to publicize a partial list of persons to be appointed judges of the superior courts was unconstitutional, and hence unlawful, null, and void.

On Thursday, June 3, President Kenyatta appointed 34 judges from a list of 41 proposed by the JSC, excluding George Odunga, Aggrey Muchelule, Joel Ngugi, Weldon Korir, Judith Cheruiyot, and Evans Makori.

The petitioner, a medical doctor, claims that the president and respondents’ actions caused the affected six judicial officers to suffer from PTSD (post-traumatic stress disorder), and he seeks an order of compensation for psychological and other forms of suffering as a result of the president and respondents’ actions.

The first respondent is the president, the second respondent is the attorney general, the third respondent is Chief Justice Martha Koome, and the fourth respondent is the attorney general in his individual role.
